GOP legislative leaders filed a legal challenge to the state's April 16 2020 "Safer at Home" order resulting in 4-3 State Supreme Court ruling on May 13 2020 striking it down.
A number of Bradley Foundation-funded groups backed the GOP's legal maneuver, by filing amicus briefs, including WMC, the Wisconsin Institute for Law & Liberty (WILL), and Charles Koch's Americans for Prosperity-Wisconsin.
Bradley and its affiliated Bradley Impact Fund has granted WILL $7.7 million and Americans for Prosperity Foundation $1.4 million between 2011 and 2020, according to tax and grant records examined by CMD.
Following the Supreme Court decision, confusion ensued as people flocked to Wisconsin's bars and pubs, and counties and cities scrambled to set their own rules to replace the state's order.
Since then, the seven-day average number of coronavirus cases in Wisconsin has more than doubled, from 286 on May 13 2020 to 755 on July 13 2020.
The Wisconsin Institute for Law and Liberty (WILL) is a nonprofit public interest law firm located in Milwaukee, Wisconsin, that says it is "dedicated to the promotion of free markets, individual liberty, and a robust civil society." The group was founded by lawyer Rick Esenberg in 2011. Esenberg sought to found a group of advocacy lawyers dedicated to conservative and libertarian causes to counter liberal legal organizations.
The organization published a study in June 2016 which found that public-sector union reforms passed in Wisconsin in 2011 had not harmed the state's public schools.
In 2016, the organization announced the launch of the Center for Competitive Federalism, a national effort to bring lawsuits and conduct research to promote state sovereignty. That same year, the organization filed a lawsuit seeking to overturn Wisconsin's Unfair Sales Act, also known as the minimum markup law, which prevents companies from selling products below cost.
In February 2020, WILL sued the Madison Metropolitan School District on behalf of 14 parents. WILL argued that the school district's policy allowing children to socially transition their gender identity without parental notification violates constitutionally recognized parental rights.
